General Terms and Conditions

1. Scope and Definitions

(1) The following General Terms and Conditions apply to all business relationships between us and the customer in the version valid at the time of the order.

(2) "Consumer" means any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.

(3) "Entrepreneur" means a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in exercise of their commercial or independent professional activity.

(4) "Customers" within the meaning of these terms and conditions are both consumers and entrepreneurs.

(5) Deviating, conflicting, or supplementary general terms and conditions of entrepreneurs shall not become part of the contract, even if known, unless their validity is expressly agreed to in writing.

2. Conclusion of Contract, Storage of Contract Text

(1) The following regulations on the conclusion of a contract apply to orders placed via our online shop.

(3) The presentation of goods in our online shop constitutes a legally binding offer to conclude a purchase contract. This offer is accepted by the customer when placing an order. The purchase contract is concluded when the customer successfully completes the ordering process.

(4) To place an order in our online shop, the customer must follow the steps outlined in our ordering process. The order is placed in the following steps:

1. Select desired product
2. Click “Add to Cart”
3. Check cart details; by clicking on the product title, the description can be reviewed; quantities can be adjusted or set to zero to remove the product from the cart
4. Click “Checkout”
5. Log in or provide shipping address
6. Click “Continue to Shipping Method”
7. Select shipping method
8. Click “Continue to Payment Method”
9. Select payment method and provide billing address if different
10. Click “Place Order” to complete and accept our offer
11. If PayPal is selected: Redirect to PayPal login, payment confirmation, then back to our shop
12. If AmazonPay is selected: Redirect to Amazon login, payment confirmation, then back to our shop
13. If SOFORT is selected: Redirect to sofort.com, enter bank details, confirm payment, then back to our shop

(5) Before submitting the order, the customer can review and correct the data at each step using the “back” button. Closing the browser cancels the process. We confirm receipt and contract conclusion via automated email.

(6) OneClickUpsell: If the customer completes a purchase using an instant payment method, additional product suggestions will appear. With a single click, more items can be ordered. The data and payment method from the initial order will be reused. This applies only immediately after the original purchase.

(7) Storage of contract text: We store the contract text and send the order data and our T&Cs by email. The terms can be accessed at www.seakingbracelets.com/Pages/AGB.

3. Prices, Shipping, Duties, Payment, Due Date

(1) Prices include VAT and other components. Shipping fees and import taxes/duties may apply additionally.

(2) Products are shipped from our warehouse in Austria.

(3) The customer chooses the payment method among the available options.

(4–7) Details on payment via PayPal, AmazonPay, or SOFORT are found on their respective terms pages.

(8) Entrepreneurs may only offset undisputed or legally established claims.

4. Delivery, Transfer of Risk

Delivery times are stated in product descriptions. Otherwise, delivery is within two weeks. Details follow for consumers and entrepreneurs regarding risk transfer and delays.

5. Retention of Title

Ownership remains with us until full payment is received. For entrepreneurs, additional provisions apply regarding resale and processing.

6. Statutory Warranty

Legal warranty applies. Different limitation periods apply to entrepreneurs. Claims for health damage or gross negligence remain unaffected.

7. Limitation of Liability

We are liable only for damages caused by slight negligence when essential contractual duties are violated. Other liability limits are detailed.
